TERMS AND CONDITIONS OF RESERVATION OF ACCOMMODATION SERVICES ELECTRONICALLY (hereinafter referred to as the „TERMS AND CONDITIONS”)

  1. PRELIMINARY PROVISIONS
    1. These terms and conditions constitute a contractual template regarding the reservation and specify the rights and obligations of the Facility and the Client.
    2. The condition for making a reservation is filling out the form, reading and accepting the Terms and Conditions, and making the payment.
    3. The Client voluntarily makes the reservation. The Facility does not charge a booking fee.
    4. The Terms and Conditions apply to reservations made from 10.05.2023 onward.
    5. The following terms used in the Terms and Conditions shall have the meaning defined in the following definitions:
      1. Client - a natural person who is at least 18 years old and has full legal capacity (consumer) or in the case of a reservation made for a company, a person who, due to their profession or the service provided to a legal person or/and an organizational unit without legal personality but having legal capacity under law, makes the reservation on its behalf and for its benefit (non-consumer);
      2. Facility – Panorama Park, Henryka Sienkiewicza 15 Świnoujście managed by Almax Anna Małolepsza-Pięciak, Address: Henryka Sienkiewicza 15, 72-600 Świnoujście, NIP: 8551579170, Email: panorama.swinoujscie@gmail.com, Phone: +48 505 505 573;
      3. Online Payments – online payment methods made available to the Client by the Facility during the reservation process.
      4. Terms and Conditions - these Terms and Conditions.
  2. TECHNICAL REQUIREMENTS
    1. To make a reservation, an Internet connection and an email account are required, to which a confirmation of the reservation (upon completion of the reservation process) or an email notifying about the interruption of the reservation process (in case of incomplete reservation) is sent.
    2. For assistance or any questions, please contact the Facility directly.
  3. RESERVATION
    1. RESERVATION CONFIRMATION MOMENT: A reservation is considered made at the moment the Facility accepts the reservation request – by sending an email to the Client confirming the reservation. If no email is received, please check the SPAM folder or contact the Facility.
    2. CHANGING THE RESERVATION: Change of the reservation by the Client consists of the following steps:
      1. the message sent to the Client will contain a link to make modifications,
      2. selecting this option will launch the online reservation management system in the web browser. Depending on the conditions of the reserved offer, cancellation and/or modification of the reservation may be possible in the system.
      3. after sending a modification request, depending on the offer configuration, it will be accepted automatically or sent to the Facility for confirmation of the status. Please note that until the Facility contacts and confirms the modification, it is not considered made.
    3. RESERVATION REFUSAL: The Facility reserves the right to refuse the reservation if there are no available rooms. In such case, the Client will automatically receive a notification on the email address provided during the reservation about the inability to make a reservation.
    4. CANCELLATION/REVOCATION OF RESERVATION: Cancellation by the Client involves the following steps:
      1. selecting the “Modify” option in the confirmation email sent to the Client,
      2. selecting this option will open the reservation management system in the web browser. In the system, select “Cancel” and then provide the reason for cancellation,
      3. after cancellation, the Client will receive a confirmation email sent to the email address provided during the reservation. In case of free cancellation and prior payment, the amount paid will be refunded to the account used for payment. Please note the cancellation confirmation received is equivalent to the cancellation itself. If no confirmation is received, check the SPAM folder and contact the Facility.
    5. RESERVATION NOTES: Notes entered in the form are not binding on the Facility. The Facility does not guarantee their fulfillment. The Facility reserves the right to contact the Client by email or phone to discuss and inform about any fees (either before or on the day of arrival), if fulfilling notes/requests requires it and their implementation only after acceptance by both Facility and Client.
    6. EXTRAS: Extras chosen in the reservation are binding for the Facility and if delivery to the room is required, it will be made no later than upon the Client's arrival, unless otherwise agreed separately by Client and Facility. For personalized extras, please contact the Facility in advance to arrange possibilities (e.g., flower types, color, etc.).
    7. PAYMENT: The Client may pay for the reservation via Online Payments. The order entails an obligation to pay.
  4. STAY AT THE HOTEL
    1. Conditions of stay at the hotel are specified in a separate Facility regulation.
    2. Reservation conditions apply directly and in case of conflict with Facility regulations, these Terms and Conditions take precedence.
    3. Reservation conditions are sent by email together with the reservation confirmation.
  5. RIGHTS AND OBLIGATIONS
    1. The Client agrees to comply with the rules in force at the Facility, including the Facility’s regulations and to settle all dues on time, and to follow all guidelines, rules and restrictions, especially those imposed by law or recommendations of the relevant authorities and services effective at the Facility.
    2. The Client is obliged to use truthful data, including personal data that they have the right to use.
    3. The Client undertakes not to act in any way contrary to generally applicable law or good practices.
    4. The Facility commits to fulfill the terms of the made reservation.
    5. The Facility reserves the right to block the Client's email address if the Client breaches the Terms and Conditions or legal provisions.
  6. LIABILITY
    1. The Client bears sole responsibility for the choice of the reservation and its suitability for their own needs as well as for the persons for whom the reservation is made.
    2. The Client is responsible for their own actions and omissions, including providing incorrect information or failure to comply with the Terms and Conditions.
    3. Neither the Facility nor the provider of the reservation engine on the website is responsible for interruption of the reservation process at the form filling stage or for so-called shopping cart abandonment (incomplete reservation) by the Client. The Client is required to restart filling in the reservation form.
    4. Leaving before the reserved checkout date does not affect the price and is equivalent to incurring charges according to the reservation conditions.
    5. Neither the Facility nor the provider of the reservation engine on the website is liable for:
      1. incorrect data entered by the Client,
      2. lack of Internet access or its limitations,
      3. restrictions and/or malfunction of software or devices belonging to the Client, which are the basis for making reservations,
      4. damages and lost benefits caused by third parties' actions or omissions, over which the Facility had no influence,
      5. damages and lost benefits caused by force majeure,
      6. payments made via Online Payments.
    6. Exclusions or limitations of liability provided in these Terms and Conditions do not apply where mandatory legal provisions prohibit limiting or excluding liability, in particular do not apply to damages caused intentionally.
    7. All claims become time-barred in accordance with applicable legal provisions.
  7. COMPLAINTS
    1. The Client has the right to submit a complaint to the Facility and have it processed within the statutory period of 14 days from receipt. Complaints should be submitted by mail to: ul. Sienkiewicza 15, 72-600 Świnoujście or electronically by email: panorama.swinoujscie@gmail.com. The complaint should contain the Client's data: name, surname, address, email provided during reservation, and a description of the issue.
    2. Immediately after the complaint is processed, the Facility will respond to the Client regarding the decision. The response will be sent in the same form as the complaint.
  8. PERSONAL DATA AND PRIVACY
    1. The rules for processing personal data and privacy protection conditions are specified in the Privacy Policy on the Facility's website.
  9. FINAL PROVISIONS
    1. The Facility has the right to make changes to the Terms and Conditions, which shall apply from the moment they are updated in the reservation engine on the website, provided that the Client who made a reservation is bound by the version valid at the time of acceptance.
    2. If any person notes a breach of the law, they are obliged to contact the Facility.
    3. In matters not regulated by the Terms and Conditions, the relevant provisions of Polish law or the law applicable to the consumer's place of residence apply.
    4. If any provision of the Terms and Conditions is changed or invalidated by a final court ruling, the remaining provisions remain in force. The Facility declares willingness to resolve disputes amicably, including pursuing claims through out-of-court ADR (Alternative Dispute Resolution). In such cases, complaints should be submitted via the website: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.show&lng=PL . The authorized entity to which complaints may be directed depends on the consumer's choice. The register of such entities in Poland including their contact details and website can be found here: https://uokik.gov.pl/pozasadowe_rozwiazywanie_sporow_konsumenckich.php . All disputes between the Facility and a Client who made a reservation not as a consumer will be resolved by the court competent for the Facility's registered office.
    5. Polish law applies and the interpretation basis is the Terms and Conditions in Polish.
